DDRH has worked with hospitals and physicians to find mutually advantageous solutions to physician employment issues, and has negotiated numerous employment and other compensation arrangements for both health care organizations and providers. The firm has significant experience counseling health care providers and organizations on the impact of the Medicare and Medicaid “fraud and abuse” laws, including the Anti-kickback law and Stark law, with respect to employment and other clinical integration efforts. The firm’s lawyers have also represented hospitals, physician groups and individual physicians in developing hospital medical groups, numerous pay-for-call arrangements, hospital-physician joint ventures, medical director arrangements and other business and clinical arrangements to assist providers in meeting the challenges of the new business realities of the health care industry.

In addition, the firm has deep experience in the area of legal compliance in physician recruiting for health care organizations, having represented health care organizations that are recruiting physicians, physicians being recruited and even third-party recruiters, with respect to the transactions. DDRH has worked closely with health care organizations to develop template recruiting contracts, as well as comprehensive recruiting policies, to ensure consistency in recruiting practices and to reduce the cost of securing physician talent.
